1.    Acceptance of Terms

These Platform Terms of Service (the “Terms”) govern access to and use of the website, mobile application, online marketplace, booking tools, messaging tools, payment facilitation tools, review tools, and related services operated by PinIt Now Inc. (“PinIt”, “we”, “us”, or “our”).

By creating an account, browsing the Platform, submitting a request, booking a service, communicating through the Platform, posting content, or otherwise using the Platform, you agree to be bound by these Terms and all policies incorporated by reference.

If you use the Platform on behalf of a business or other legal entity, you represent and warrant that you have authority to bind that entity. In that case, the words “you” and “your” include both you and that entity.

If you do not agree with these Terms, you must not access or use the Platform.

2.    Related Documents and Order of Precedence

Use of the Platform is also governed by PinIt’s Privacy Policy, Platform Safety and Acceptable Use Policy, any booking confirmation, any pricing schedule displayed at checkout, and any supplemental terms presented for a specific feature or service category.

Service providers are also bound by the PinIt Service Provider Agreement. If there is a conflict between these Terms and the Service Provider Agreement in relation to a Provider’s obligations, the Service Provider Agreement governs as between PinIt and the Provider.

A booking confirmation and any mandatory consumer disclosure presented at checkout govern the specific Booking to which they relate, but only to the extent they are consistent with applicable law.

3.    No Waiver of Statutory Rights

Nothing in these Terms limits, excludes, restricts, waives, or releases any right, benefit, protection, remedy, or cancellation right that cannot be limited, excluded, restricted, waived, or released under applicable consumer protection, privacy, electronic commerce, anti-spam, employment, occupational health and safety, human rights, or other legislation.

Where any provision of these Terms is inconsistent with a non-waivable statutory right or remedy, the statutory right or remedy prevails and the provision will be interpreted only to the maximum extent permitted by law.

4.    Definitions

  • “Account” means a registered account on the Platform.
  • “Booking” means a confirmed service request made through the Platform.
  • “Customer” means a User who requests, books, purchases, receives, or pays for Services through the Platform.
  • “Provider” means an independent service provider who lists, offers, quotes, accepts, performs, or supplies Services through the Platform.
  • “Platform” means PinIt’s website, mobile application, systems, software, communications tools, booking tools, payment facilitation tools, review tools, and related technology.
  • “Service” or “Services” means the work, labour, materials, advice, visit, inspection, repair, maintenance, installation, estimate, or other service supplied by a Provider to a Customer.
  • “User” means any person who accesses or uses the Platform, including Customers and Providers.

Words importing the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

5.    Nature of the Platform

PinIt operates a technology-based marketplace that allows Customers to search for, communicate with, book, and pay independent Providers. PinIt is not itself a plumber, electrician, renovator, cleaner, mover, contractor, home inspector, engineer, architect, security company, health care provider, emergency service, or other trade or professional service provider unless PinIt expressly states otherwise in a written agreement signed by an authorized officer.

Services are offered and supplied by Providers, not by PinIt. Any contract for Services is formed directly between the Customer and the Provider. PinIt is not a party to the service contract between the Customer and the Provider, except to the limited extent PinIt facilitates Platform access, communication, payment processing, administrative support, safety review, and dispute-management tools.

PinIt does not supervise, direct, control, inspect, manage, warrant, or guarantee any Provider’s performance, availability, tools, employees, subcontractors, materials, pricing, licensing, regulatory compliance, workmanship, or results. PinIt may conduct identity, eligibility, document, background, insurance, or licence checks, but any such check is limited in scope and is not an endorsement, guarantee, warranty, or certification of the Provider.

Search rankings, visibility, badges, recommendations, and placement may be influenced by availability, location, responsiveness, customer ratings, cancellation history, dispute history, service category, price, account status, compliance status, platform performance, and other operational criteria. PinIt does not guarantee any Provider’s ranking, visibility, revenue, bookings, or results.

6.    Eligibility and Account Registration

You must be at least 18 years old and have legal capacity to enter into binding contracts to create an Account or make a Booking. The Platform is not intended for children or for use by persons under the age of 18.

You must provide accurate, complete, and current information and must promptly update your Account if information changes. You are responsible for all activity under your Account and must keep login credentials confidential.

PinIt may refuse registration, require additional information, suspend an Account, restrict features, cancel a Booking, or terminate access where PinIt reasonably believes that information is inaccurate, incomplete, misleading, fraudulent, unlawful, unsafe, or creates operational, legal, regulatory, reputational, or financial risk.

7.    Customer Responsibilities

Customers are responsible for choosing the Provider and Service suitable for their needs, reviewing the Provider’s profile, service description, price, availability, cancellation terms, ratings, and any other information displayed before booking.

Customers must provide accurate service details, service address, access instructions, safety information, parking or building requirements, contact information, photos, and other details reasonably required to perform the Service.

Customers must ensure that the service location is safe, lawful, accessible, and suitable for the booked Service. Customers must disclose hazards, animals, restricted access, building rules, strata requirements, permits, or other material conditions that may affect the Provider’s ability to attend or perform the Service.

Customers must not request, require, or permit a Provider to perform illegal, unsafe, unlicensed, or regulated work that the Provider is not legally authorized to perform.

8.    Provider Status and Provider Responsibilities

Providers are independent businesses. Providers are not employees, agents, representatives, partners, joint venturers, subcontractors, fiduciaries, or franchisees of PinIt. Providers have no authority to bind PinIt.

Providers are solely responsible for their Services, including pricing, taxes, tools, materials, staffing, scheduling, quality, safety, licences, permits, registrations, insurance, workers’ compensation, employment standards, occupational health and safety, subcontractors, and compliance with all applicable federal, provincial, municipal, and regulatory requirements.

PinIt may remove, suspend, or restrict a Provider if PinIt reasonably believes the Provider is not qualified, insured, licensed, authorized, safe, responsive, compliant, or suitable for continued access to the Platform.

9.    Bookings and Electronic Contracting

The Platform may allow Customers to request quotes, book fixed-price Services, book time-based Services, request on-site estimates, request urgent attendance, or communicate with Providers before confirming a Booking. A Booking is confirmed only when the Platform confirms acceptance and the required payment authorization or payment has been successfully processed through the designated payment processor.

Before a Customer enters a Booking, the Platform is intended to present material terms in electronic form, including the Provider’s identity or business name, service description, service date or supply date, price or pricing method, applicable taxes and fees, payment terms, cancellation terms, refund terms, contact information for notices, and any other information required by applicable law for the specific transaction.

After a Booking is confirmed, the Platform or payment processor may provide an electronic confirmation, receipt, invoice, or copy of the Booking terms by email, account message, downloadable receipt, or another method that allows the Customer to retain the information.

If a Service requires additional work, parts, materials, visits, permits, or price changes, the Customer and Provider must agree to those changes through the Platform before the additional amount is charged, unless immediate action is necessary to address an urgent safety issue and applicable law permits the charge.

10. Pricing, Taxes, Payment Processing, and Receipts

Prices, fees, taxes, cancellation charges, no-show charges, and other amounts are displayed in Canadian dollars unless the Platform states otherwise. The total price shown at checkout is the amount authorized or charged for the relevant Booking, subject to later agreed changes, statutory refunds, chargebacks, reversals, adjustments, or payment processor requirements.

Payments are processed by one or more third-party payment processors. PinIt does not intend to collect, receive, or hold Customer funds in PinIt’s own bank account as a deposit-taking institution, escrow agent, trustee, money services business, insurer, or financial institution. Payment processor terms may apply.

The Provider is the supplier of record for Services performed by the Provider. PinIt may facilitate invoicing or receipts on the Provider’s behalf, but the Provider remains responsible for the accuracy of invoices, applicable GST/HST/PST and other taxes, regulatory charges, and tax remittances unless applicable law provides otherwise.

By submitting a Booking, the Customer authorizes the payment processor to charge the selected payment method for the Booking amount, applicable taxes, platform fees, cancellation charges, no-show charges, additional charges approved through the Platform, and any other amounts disclosed before authorization.

PinIt is not responsible for payment card issuer decisions, banking delays, payment processor holds, account freezes, chargebacks, reversals, fraud reviews, declined transactions, or settlement timing.

11. Cancellations, Rescheduling, No-Shows, Refunds, and Consumer Cancellation Rights

Customers and Providers may cancel or request rescheduling only through the Platform unless PinIt authorizes another method. Cancellations and rescheduling may be subject to the cancellation policy displayed before the Booking is confirmed.

A cancellation or no-show charge may apply depending on the timing of the cancellation, the Provider’s attendance, access to the service location, and the cancellation policy disclosed before booking. Unless a higher amount is expressly permitted by applicable law and disclosed before booking, a cancellation or no-show charge processed through the Platform will not exceed CAD $100 per Booking.

If a Provider cancels a confirmed Booking without valid justification, the Customer may be entitled to a full refund and the Provider may be subject to account consequences under the Service Provider Agreement.

For any consumer transaction to which the Business Practices and Consumer Protection Act or similar legislation applies, statutory cancellation and refund rights are preserved. In particular, where applicable, a Customer may have rights to cancel an online or distance sales contract if required information is not provided, a copy of the contract is not provided within the prescribed time, or the goods or services are not supplied within the required time. Statutory refunds must be handled within the time required by applicable law.

A request for Platform review, complaint, or dispute under these Terms does not limit a Customer’s statutory cancellation rights, credit card chargeback rights, court rights, tribunal rights, privacy rights, or other non-waivable legal rights.

12. Service Issues, Workmanship, and Platform Review

Customers and Providers are encouraged to communicate through the Platform in good faith to resolve service concerns. Unless a different period is disclosed for a specific Booking, the parties should communicate service-related concerns within 14 calendar days after Service completion.

Providers may be required under the Service Provider Agreement or their own service warranties to address workmanship concerns for a minimum period of 14 calendar days after completion. Any Provider warranty is provided by the Provider, not by PinIt, unless PinIt expressly states otherwise in a written warranty issued by PinIt.

A Customer may request Platform review of a Booking by opening a dispute through the Platform within 48 hours after Service completion. PinIt may request photos, messages, receipts, attendance records, inspection details, and other information from the Customer and Provider.

PinIt may, where reasonably necessary to address fraud, safety, contractual breach, chargeback risk, payment error, or dispute resolution, facilitate settlement adjustments, refunds, partial refunds, payout holds, charge reversals, account restrictions, or other operational steps. PinIt’s Platform review is an internal administrative process and does not make PinIt the supplier of the underlying Service.

13. Reviews, Ratings, and User Content

Users may be able to post reviews, ratings, messages, photos, profile information, service descriptions, comments, and other content. Users are solely responsible for content they submit.

PinIt does not prohibit Customers from posting an honest review of a Provider or Service. PinIt may, however, remove, restrict, refuse, edit for formatting, or moderate content that PinIt reasonably believes is false, misleading, defamatory, discriminatory, harassing, threatening, unlawful, irrelevant, spam, promotional, privacy-invasive, unsafe, abusive, fraudulent, extortionate, or otherwise in breach of these Terms or the Platform Safety and Acceptable Use Policy.

By submitting content, you grant PinIt a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, publish, distribute, adapt, remove, and use the content for Platform operation, marketing, safety, compliance, analytics, dispute resolution, and enforcement, subject to the Privacy Policy and applicable law.

You represent and warrant that you own or have all rights required to submit your content and that your content does not infringe or violate any third-party rights.

14. Platform Safety, Messaging, and Prohibited Conduct

Users must comply with the Platform Safety and Acceptable Use Policy. Without limiting that policy, Users must not use the Platform to commit fraud, impersonate others, harass, threaten, discriminate, bully, exploit, promote unlawful services, exchange illegal content, share non-consensual intimate content, share content involving child exploitation, promote terrorism or violent extremism, incite violence, foment hatred, encourage self-harm, evade safety tools, or interfere with Platform operation.

Users must not use the Platform to arrange illegal work, dangerous work, unlicensed work, off-platform transactions, payment circumvention, money laundering, stolen goods, weapons, controlled substances, adult services, gambling services, surveillance abuse, or any service or content that PinIt prohibits.

Users must not share phone numbers, email addresses, payment links, external booking links, social media accounts, websites, or other direct contact information for the purpose of avoiding Platform fees, payment protections, safety review, or dispute processes.

PinIt may monitor, access, review, retain, and disclose Platform communications and content for safety, security, fraud prevention, compliance, dispute resolution, legal enforcement, and operational purposes, in accordance with the Privacy Policy and applicable law.

15. Intellectual Property

PinIt and its licensors own all rights, title, and interest in and to the Platform, including software, code, design, user interface, databases, trade names, trademarks, logos, graphics, workflows, algorithms, ranking systems, and proprietary technology.

Subject to these Terms, PinIt grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for its intended purpose. You must not copy, modify, reverse engineer, scrape, crawl, extract, resell, sublicense, interfere with, or create derivative works from the Platform except as expressly permitted by law.

16. Privacy and Electronic Communications

PinIt collects, uses, discloses, stores, and safeguards personal information in accordance with its Privacy Policy and applicable privacy legislation. By using the Platform, you acknowledge that Platform operation requires the collection and sharing of certain information between Customers, Providers, payment processors, verification providers, hosting providers, analytics providers, support providers, regulators, and other persons described in the Privacy Policy.

You consent to receive transactional, administrative, safety, booking, payment, account, and legal notices electronically. Marketing messages will be sent only where PinIt has consent or another legal basis to do so and will include any required identification and unsubscribe mechanism.

17. Third-Party Services

The Platform may link to or integrate with third-party services, including payment processors, identity verification tools, map services, messaging tools, analytics tools, app stores, background screening providers, and hosting providers. PinIt is not responsible for third-party terms, policies, acts, omissions, delays, errors, outages, or security incidents except to the extent required by applicable law.

Use of third-party services may require you to agree to additional terms. If you do not accept applicable third-party terms, certain Platform features may not be available.

18. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, PinIt disclaims all representations, warranties, and conditions, whether express, implied, statutory, or collateral, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, security, accuracy, completeness, availability, reliability, ranking, matching, service quality, Provider qualifications, or service outcome.

PinIt does not warrant that any Provider will attend on time, complete the Service, perform the Service safely, hold required licences, maintain insurance, honour a warranty, comply with law, or resolve a dispute. Customers should make their own inquiries and exercise their own judgment when selecting and dealing with Providers.

19. Limitation of Liability

Subject to the No Waiver of Statutory Rights clause and to the maximum extent permitted by law, PinIt will not be liable for indirect, incidental, special, exemplary, punitive, aggravated, consequential, economic, or business losses, including loss of profits, revenue, goodwill, data, use, opportunity, or anticipated savings.

Subject to applicable law, PinIt’s total aggregate liability arising from or relating to the Platform, these Terms, or any Booking will not exceed the greater of: (a) the platform fees actually received by PinIt in relation to the Booking giving rise to the claim; and (b) CAD $100.

The limitations in this section do not apply to liability that cannot be limited by law, including fraud, wilful misconduct, or any other category of liability for which exclusion or limitation is prohibited by applicable law.

20. Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless PinIt, its directors, officers, employees, contractors, agents, affiliates, successors, and assigns from and against claims, losses, damages, liabilities, fines, penalties, costs, and expenses, including reasonable legal fees, arising from or relating to: (a) your breach of these Terms; (b) your content; (c) your misuse of the Platform; (d) your breach of law; (e) your Service, Booking, or dispute with another User; or (f) your negligence, wilful misconduct, fraud, or misrepresentation.

This indemnity does not require a consumer to indemnify PinIt where such obligation is prohibited by applicable consumer protection legislation.

21. Suspension, Termination, and Platform Changes

PinIt may modify, suspend, restrict, or discontinue any feature or part of the Platform at any time. PinIt may suspend or terminate an Account, remove content, cancel Bookings, withhold access to features, or restrict communications if PinIt reasonably believes that continued access creates legal, regulatory, safety, security, payment, fraud, reputational, or operational risk.

You may stop using the Platform at any time. Termination does not affect obligations that accrued before termination, including payment obligations, refund obligations, chargebacks, dispute cooperation, confidentiality, intellectual property, privacy, indemnity, and limitations of liability.

22. Dispute Resolution and Governing Law

Users are encouraged to first contact PinIt support and attempt to resolve concerns informally. Informal resolution is voluntary and does not limit statutory rights or limitation periods unless the parties agree otherwise in writing after the dispute arises.

For consumer contracts and consumer disputes, these Terms do not require mandatory arbitration, do not require a consumer to waive participation in a class proceeding where such waiver is prohibited, and do not restrict any right that cannot be restricted under applicable law.

Subject to applicable law, these Terms and any dispute arising from or relating to the Platform are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia. Subject to any court, tribunal, regulatory, or statutory jurisdiction that cannot be excluded, the courts of British Columbia have jurisdiction over disputes arising from or relating to these Terms.

23. Changes to These Terms

PinIt may update these Terms from time to time by posting updated Terms, providing notice through the Platform, sending notice electronically, or using another reasonable method. The updated Terms apply prospectively from the effective date stated in the notice unless applicable law requires otherwise.

If a change materially affects an existing Booking, the terms accepted at the time of that Booking continue to govern that Booking unless the Customer and Provider agree otherwise or applicable law permits the change. Continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms.

24. General

These Terms, together with incorporated policies and any Booking-specific terms, constitute the entire agreement between you and PinIt regarding Platform use. If any provision is held invalid or unenforceable, the provision will be interpreted to the maximum extent enforceable and the remaining provisions remain in effect.

PinIt may assign these Terms in connection with a merger, acquisition, financing, restructuring, sale of assets, corporate transaction, or by operation of law. You may not assign your rights or obligations without PinIt’s prior written consent.

PinIt is not liable for delay or failure to perform caused by events beyond its reasonable control, including internet outages, platform outages, payment processor issues, labour disputes, natural disasters, public health emergencies, cyber incidents, power failures, acts of government, war, terrorism, civil unrest, or force majeure events.

Sections intended by their nature to survive termination will survive, including payment, refunds, dispute cooperation, intellectual property, privacy, confidentiality, prohibited conduct, disclaimers, limitation of liability, indemnity, governing law, and general provisions.
